Employee contracts are a bit like marriages and not just because they’re binding. Too often it’s a case of ‘Write a contract in haste, regret it at your leisure’. A new financial year is upon us and what better time to share a few cautionary words and common scenarios.





 

Fail #1: Not providing a ‘Position Description’

We know people are busy and these can be quite lengthy – but honestly a detailed position description is well worth your time. A good solid, exhaustive PD can save you many headaches in the long run if people start wheeling out the ‘That’s not my job’ and ‘I wasn’t told this was part of my role’ lines. Then you can just point and breathe a sigh of relief.

Fail #2: Relying on cut-and-paste templates

Appropriating templates you find online and get ahold of elsewhere is never a good idea. They may have been created with international IR law in mind/20 years ago/as a joke/who knows? Compliance with legislation is absolutely crucial here so if you’re going to use a template, make sure it was drawn up with (current) legally compliant advice.

Fail #3: Being out of touch with legislation

Guidelines and laws covering workplace practices and employee rights and entitlements tend to be fickle. It’s all very political too and don’t forget there’s an election looming. If you have something to do with recruitment and payroll, you must keep up with these. Easier said than done, we know.
