Labour hire managers fined for unlawful pay deductions

A labour hire company director and its HR manager have been personally fined for unlawfully deducting amounts from on-hire workers' wages and concealing evidence of their actions.

The Federal Circuit Court fined Oz Staff Career Services Pty Ltd (OSCS) director Travice Blom $14,960 for unlawfully deducting $130,000 from the wages of 102 Melbourne cleaners and falsifying pay records to hide the practice.

It also fined the company's former human resources manager Alex Linossi $9,920 for his involvement in the unlawful activity.

Between December 2011 and May 2013, OSCS subtracted around $25 from employees' wages per week under the guise of 'administration fees', and lesser amounts for 'meal fees' in 2012 and 2013, the Court found in a February ruling.

OSCS's employees at the time were cleaners working under contracts at Federation Square and Crown Casino in Melbourne, and almost all of them have now been back paid in full, according to Fair Work Ombudsman Natalie James.

The FWO could not seek penalties against OSCS as the company entered liquidation last year.
