Calling all Business Owners and HR managers: whatever you do in your official capacity, you’re merely following policy and towing the company line, right? Wrong. 

Decisions are your call in the eyes of the law and it’s your responsibility to keep on top of changing rules and regulations. How big or small the company you work for is no protection.
 

We hate to break it to you, but you could be personally liable for Fair Work contraventions. NOT your employer. Not your corporation. You personally. As in you could have to write a cheque for fines incurred on your watch in cases concerning:
  • Incorrect rates of pay
  • Unfair dismissal
  • Harassment or discrimination
 
So could admin staff. And payroll. And those fines can run into thousands of dollars. Plus, you could be named and shamed by the Fair Work Commission.
 
Culpability all depends on who makes the decision – most often accidentally – to do the wrong thing. It’s rare but it happens.
 
How can you be sure this never happens to you? By double-checking everything to do with how much your employees are paid (the minimum wage just increased FYI) and making sure you follow standard procedures to do with contracts, warnings, performance reviews and dismissals to the letter.
