Fair Work Findings

8 December 2017

Based on the latest report from the Fair Work Ombudsman (FWO), workplace disputes are a growing problem.

During the 2016-17 financial year, the FWO resolved nearly 27,000 requests for assistance involving a workplace dispute – this is up nine per cent from the previous year.

When you run a business, you have enough to worry about and while workplace compliance isn’t always front of mind, it’s important to be informed of current trends that can affect your business.

You also need to be aware of the following alarming findings highlighted in the report:
  • The Ombudsman recovered more than $30.6 million in unpaid wages for more than 17,000 workers through requests for assistance involving a workplace dispute and FWO-initiated activities (up 66 per cent from the previous year)
  • Anonymous reporting is a huge success for employees – with 10,535 tip-offs to the FWO (particularly in the hospitality and retail sectors)
  • The Ombudsman ordered $4,864,925 in penalties to be paid by employers who breached legislation (compared to $2,918,643 in 2015-16 - an increase of 66 per cent)
  • Of the businesses audited, the Ombudsman reports an overall compliance rate of 53 per cent, a decrease of eight per cent when compared with 2015-16
  • Pay slip and record keeping contraventions up by 10 per cent – also increasing on-the-spot penalties
