$188,100 penalty for underpaying trolley pushers

The underpayment of trolley collectors has been a prominent issue within Australian for many years.

Trolley collectors are arguably among the most vulnerable and potentially-exploited workers, with Census data showing many are young, do not have an education level beyond Year 10, come from non-English speaking countries and have physical or other disabilities.

A former company director and operations manager have been penalised $188,100 for underpaying 10 trolley collectors by more than $220,000.

Employees were short-changed over a 18 month period where one migrant worker from India was underpaid approximately $90,000.

Some collectors were paid as little as $5 an hour resulting in a 75 per cent maximum penalty being applied to the employers.

The company fell bankrupt however this did not impact the penalty imposed on the employer. Fair Work Ombudsman Natalie James welcomed the penalties “this is the culmination of a lot of hard work by the Agency’s Overseas Workers Team to develop a strategy to stop the exploitation of vulnerable workers in the non-compliant trolley collecting industry.”
