Not all heroes and employers wear their underpants on the outside, right? Let’s just say you’re a good egg who’s prepared to go the extra mile for staff. And when a staff member has crossed the line, you’re on the front foot of responsible management, taking charge of tough conversations.
 
But managing allegations of bullying and harassment in the workplace can be particularly stressful – especially if they are levelled at you.

Claims lodged with the Fair Work Ombudsman can result in hefty fines. In extreme case scenarios, they can financially ruin a business.
 
Recently, an employer was fined a whopping $532,000 by the Ombudsman after being found guilty of bullying and harassment, including breaches in exploiting international worker pay entitlements.
 
Undoubtedly, this was a worst-case scenario in every sense, but it does speak to the Ombudsman’s vigilance. Why take the smallest chance?
 

To remove the risk from your workplace, assess your answers to the questions below:

  • Have you asked staff to pay back wages because you accidentally overpaid them (this is a workplace breach)

  • Are you absolutely 100% that you are paying your staff the correct and lawful pay entitlements? (the minimum wage rate was increased on 1 July 2016)

  • Do your staff experience bullying or harassment at your workplace? (did you know that you are held personally accountable?)

  • Your employment and pay records are legitimate, not falsified and comply with the Fair Work Act 2009. (even skipping on providing your staff with payslips is a breach!)

  • Do you have international expatriates on a working Visa? Make sure you are providing them with the wages and entitlements that fall within their Visa specifications.
