Circular: Update to the Textile, Clothing, Footwear and Associated Industries Award 2010

As a result of the 4-yearly review of modern awards, the Fair Work Commission issued a decision on 3 December 2020 to address several outstanding matters in the Textile, Clothing, Footwear and Associated Industries Award 2010. This decision is significant as it concludes the re-drafting process of the Award that aimed to address some of the structural issues known in modern awards and to apply plain language drafting principles and techniques. A final variation determination was issued on 4 December 2020 that incorporated the changes outlined in the decision.


What are the other changes?

The varied Award will have the year ‘2020’ in its title and include summaries of the hourly rates of pay and monetary allowances in the schedules of the Award. It will also incorporate the decisions and determinations that have been issued as part of the review process that relate to the following notable issues:
  • Calculation of overtime for casuals clarified (based on a cumulative method, rather than compounding approach)
  • Calculation of penalty rates for casuals re-inserted (with corrections) into several tables in Schedule C-Summary of Hourly Rates of Pay-General
  • Clarification in coverage clauses relating to employers which supply labour on an on-hire basis and employers which provide group training services
  • Meal break provision for shift workers
  • Insertion of ‘all purposes’ definition
  • Redundancy pay for employee of small business employer with at least 4 years and over continuous service

Other changes that have also been incorporated into the varied Award include issues relating to:
  • Wages and expense-related allowances that reflect the adjustment in accordance with the Annual Wage Review 2019-20 Decision;
  • Schedule X—Additional Measures During the COVID-19 Pandemic being extended until 29 March 2021.


When will the changes come into effect?

These changes will be effective from the start of the first full pay period on or after 1 February 2021.
