Perth cleaning contractor faces court over alleged overseas worker underpayments

The Fair Work Ombudsman commenced legal action against employer for underpaying employees. Young overseas workers on 417 visas were underpaid by $9359, after performing between two to four weeks of work without payment.

The employer additionally underpaid an overseas marketing specialist entitled to eighteen weeks of work amounting to $4000. Australian citizen and manager of the cleaning business was also short-changed over $13,000. In total six employees were underpaid by $26,627.

Breaches of frequency-of-pay and pay-slip laws are also alleged.

The employer faces maximum penalties up to $10,200 and the company faces maximum penalties of up to $52,000, per contravention.

The Fair Work Ombudsman is seeking a Court Order to back-pay all workers in full and is conducting a national review of wages and conditions of overseas workers in Australia on the 417 working holiday visas; as complaints from overseas workers are at an all-time high.

Fair Work Ombudsman Natalie James states “While we have always had a strong focus in relation to visa-holders, we now give these vulnerable employees priority and have invested significant resources to assist them.”
