In response to receiving a joint application, the Full Bench of the Fair Work Commission ('Commission') issued a decision on 22 December 2020 to extend the operation of Schedule I – Award flexibility during the COVID-19 pandemic in the Clerks Private Sector Award 2020 until 30 June 2021.

Schedule I first came into operation on 28 March 2020 and the Commission has granted 4 applications in total to extend its operation. Prior to the most recent decision, Schedule I was due to cease operating on 29 March 2021.
The decision also provides for further amendments to Schedule I to deal with remote working arrangements.


What are the other changes?

The most important points to note are below:
  • Clause I.2.1 will be amended to read ‘For the purposes of clause I.2.1, Remote Work means work undertaken by an employee from their home or any other location of their choosing that is not the premises of their employer.’
  • The same extended span of hours for days workers perform remote work as the current Schedule I will remain, that is from 6.00 am to 10.00 pm, Monday to Friday, and from 7.00 am to 12.30 pm on Saturday.
  • Terms that will provide for the following additional flexibilities while undertaking remote work will be added to Schedule I:
    • employees may choose to work their hours non-continuously;
    • with agreement from their employer, part-time employee can choose their own starting and finishing times;
    • subject to agreement with the employer, flexibility in taking of meal or rest breaks by employees


When will the changes come into effect?

These changes came into effect from the start of the first full pay period on or after 22 December 2020.
