COVID-19 and 4 yearly review of modern awards

Over the past few weeks, the Full Bench of the Fair Work Commission ('FWC') issued several decisions varying multiple modern awards. Understanding the latest modern awards that apply to employees is necessary to meet employment and work, health and safety minimum standards.


Modern awards

The technical and drafting matters for the Tranche 2 awards listed below have been finalised in line with decisions [[2020] FWCFB 690], [2020 FWCFB 1541] and [[2020] FWCFB 1814] issued by the FWC on 14 February 2020, 23 March 2020 and 27 April 2020.  
 
The final determinations for the individual awards listed below were issued with extensive variations to the awards which came into effect from the ffppooa 29 May 2020.
 
These awards will now have the year ‘2020’ in their title and if you are subscribed to the updates for any of the below awards, your subscription will be automatically transferred to the new award.
  • Clerks—Private Sector Award (see determination for further information)
  • Contract Call Centres Award
  • Educational Services (Schools) General Staff Award
  • Hospitality Industry (General) Award (see determination for further information)
  • Local Government Industry Award
  • Manufacturing and Associated Industries and Occupations Award
  • Rail Industry Award
  • Restaurant Industry Award (see determination for further information)
 
The above additional determinations issued by the FWC are to address substantive issues relating to specific awards.


Fast Food Industry Award 2010

On 19 May 2020, the FWC issued a determination for variations to the Fast Food Industry Award 2010 to assist employers and employees in preserving the viability of businesses and preserving jobs during the COVID-19 pandemic.
 

What are the changes?

  • Inserting Schedule H to include provisions enabling employers and employees who do not qualify for JobKeeper payments to agree on flexible part time employment terms, and employers to request their full time and part time employees to take annual leave with a minimum of 72 hours’ notice.

When do the changes come into effect?

These changes operate from the start of the first full pay period on or after (“ffppooa”) 19 May 2020 until 31 July 2020.

Vehicle Manufacturing, Repair, Services and Retail Award

In accordance with the correction determination issued by the Full Bench of the FWC on 30 April 2020, the new Vehicle Repair, Services and Retail Award 2020 came into effect from the start of the ffppooa 29 May 2020. It is important to note that all vehicle manufacturing employers and employees will be covered by the Manufacturing and Associated Industries and Occupations Award 2020 from this date.
 
If you are subscribed to the Vehicle Manufacturing, Repair, Services and Retail Award 2010, your subscription will be automatically transferred to the Vehicle Repair, Services and Retail Award 2020.


Amusement, Events and Recreation Award 2010

On 27 April 2020, the FWC issued a determination for variations to the Amusement, Events and Recreation Award 2010 to include golf industry-related coverage and classifications, and an entitlement to a 17.5% annual leave loading.

Sugar Industry Award 2020

On 21 May 2020, the FWC issued a determination for the Sugar Industry Award 2020 to resolve issues relating to the plain language re-drafting of the redundancy clause. The determination clarifies where redundancy pay and notice of termination entitlements apply for apprentices or fixed-term employees in sugar mills.
 

What are the changes?

  • Deletion of clause 16. Redundancy and insertion of the new clause “16. Redundancy” outlined in the determination.

When do the changes come into effect?

The determination came into effect from the start of the ffppooa 1 June 2020.
