Update to the Joinery and Trades Building Award

As a result of the 4-yearly review of modern awards, on 4 December 2020, the Fair Work Commission handed down a decision ([2020] FWCFB 6040) to address several outstanding technical and drafting matters in the Building and Construction General On-Site Award 2010 (On-Site Award), Joinery and Building Trades Award 2010 (Joinery Award), Mobile Crane Hiring Award 2010 (Mobile Crane Award) and the Plumbing and Fire Sprinklers Award 2010 (Plumbing and Fire Sprinklers Award) (collectively the ‘Construction Awards’). The re-drafting process of the modern awards aimed to address some of the known structural issues in the modern awards and applied plain language drafting principles and techniques. This part of the review did not deal with substantive issues in the Construction Awards as these were predominantly dealt prior to this decision (see links to the exposure drafts below).


What are the other changes?

The varied Construction Awards will have the year ‘2020’ in their titles and include summaries of the hourly rates of pay and monetary allowances in the schedules of the Awards. Below is a summary of the main drafting issues in the final exposure draft of the Joinery Award that were addressed in the decision.


Joinery Award

  • Additional provisions (clauses 17.1 Rostering arrangements, 18.1(b) Meal breaks and 24.9(b) Time off instead of payment for overtime) inserted in the table at clause 7.2 regarding facilitative provisions
  • Amendment to clause 13.5(c) to include additional reference to the Australian Industry Skills Committee for consistency with Schedule E
  • The reference to the “Construction and Property Services Industry Skills Council” in clause 13.5(c) replaced by “Construction, Plumbing and Services Industry Reference Committee”
  • The reference to “clause 13” in clause 13.11(c) changed to “clause 13.11(b)”
  • The reference in clause 22.7 to “clause 2—Definitions” correctly updated to reference “clause 22.2(a)”
  • Insertion of additional wording “Clause 37.4 supplements the NES by providing redundancy pay for employees of a small business employer.” in the note at 37. Redundancy
  • Amendment to explanatory notes at the beginning of Schedule B – Summary of Hourly Rates of Pay for clarification on applicability of industry allowances and all-purpose allowances
  • Amendment to move the column titled “afternoon or night” in tables at B.2.3 Full-time and parttime shift workers—ordinary and shift rates, B.2.6 Casual shiftworkers—ordinary and shift rates, B.3.3 Full-time and part-time shiftworkers—ordinary and shift rates, and B.3.6 Casual shiftworkers—ordinary and shift rates across the table under the heading “all shiftwork” next to the public holiday column
  • Amendments in the footnotes throughout the tables at B.3 Full-time, part-time and casual employees (engaged on joinery work, shopfitting, stonemasonry, outside work, or other than factory glazing) and B.5 Apprentices (engaged on joinery work, shopfitting, stonemasonry, outside work, or other than factory glazing) to clarify whether industry allowances, tool allowances, or other all-purpose allowances are included or not included in the rates provided

Other changes that have also been incorporated into the varied Constructions Awards include issues relating to:
  • Calculation of overtime for casuals clarified
  • Wages and expense-related allowances that reflect the adjustment in accordance with the Annual Wage Review 2019-20 Decision (effective 1 November 2020);
  • Schedule X—Additional Measures During the COVID-19 Pandemic being extended until 29 March 2021 (excluding the Plumbing and Fire Sprinklers Award)


When will the changes come into effect?

These changes will be effective from the start of the first full pay period on or after 1 March 2021.
