Update to the Vehicle Repair, Services and Retail Award 2020

On 3 August 2021, Commissioner Bissett of the Fair Work Commission issued a determination resulting from decisions to vary the Vehicle Repair, Services and Retail Award 2020. These decisions aimed to remove the ambiguity and uncertainty within the terms of the Award relating to junior or adult rates of pay for driveway attendants, roadhouse attendants and console operators aged 20 years.

Commissioner Bissett found that the ambiguity and uncertainty in the Award was due to conflicting clauses on the details of junior rates of pay for 20-year-old driveway attendants, roadhouse attendants and console operators, and the different arrangements that apply dependent on whether those employees were casual or permanent employees. In summary, some clauses suggested that 20-year-old roadhouse attendants, driveway attendants and console operators were to be paid adult rates of pay while other clauses suggested that they were to be paid junior rates of pay.

The decisions clarified the following:

  • there is no error, or any ambiguity or uncertainty contained in the rates of pay for casual driveway attendants, roadhouse attendants and console operators at 20 years of age and over set out in clauses 27.3(a) and B.4
  • junior rates of pay apply for weekly hire, full-time and part-time driveway attendants, roadhouse attendants and console operators employees at 20 years of age (and younger) as stated in clauses 16.6(a) and (c)
  • the definition of ‘adult roadhouse attendant’ in clause 2 and the headings of the tables at clauses B.3.1, B.3.2 and B.3.3 were incorrect and created uncertainty in the application of the correct rates of pay under the Award.


What are the main changes?

  • Deletion of ‘adult’ and ’20 years of age or over’ in the ‘adult roadhouse attendant’ definition in clause 2
  • Deletion of the words ‘(20 years and over)’ wherever they appear in the headings at clauses B.3.1, B.3.2 and B.3.3
  • Insertion of a row for ’20 years’ with the appropriate rates in accordance with clause 16.6(a) and(c) in the tables at clauses B.3.4(a), B.3.4(b), B.3.4(c), B.3.5(a), B.3.5(b) and B.3.5(c)


When did changes come into effect?

The changes came into effect on 4 August 2021.
